Two permit applications created some discussion, and some disagreement, during the Planning Commission meeting on Monday night due to parking and ocean views.
The first permit, which was approved by the Commission, will allow the demolition of an existing single-family home and construction of a new two-story single-family home on Camino Capistrano.
Members of the public voiced their concern over the project, stating the two-story construction will block their ocean views.
“I’m very sympathetic to the residents who feel the redevelopment of this property … will negatively impact them, and I understand they’ve had a view for a potentially long time,” said Commissioner Scott McKhann. “But I’d like to point out, our rule on Planning Commission; we don’t have a view protection ordinance.”
He added that as a commissioner, he must look at the proposal and see what the parameters of the zoning codes and see if the property fits within those parameters.
Commissioner Roy Dohner agreed.
“I also feel very sympathetic,” Dohner said. “Our job is to follow the rules here, and there is no protection. On that street, there are multiple two-story homes as well as one-story homes. I’m inclined to approve this based on that.”
The Commission voted five to zero in favor of the project.
The second project, which was tabled for further discussion with the architect, is the construction of two detached dwelling units on each of two contiguous sites off of Via Verde.
Some members of the Commission were not in favor of the project due to the parking that was planned—some said there wasn’t enough in comparison to the amount of bedrooms the project called for.
In the plan there were, in total, 20 bedrooms, with 10 parking spots.
“I just don’t see where all the parking is going to come from,” said Commissioner Danni Murphy.
Commissioner Dohner said this is a project that once the developer is finished with it, they would go away and make the city deal with the parking issues.
“Personally, I know it meets the code but I believe that the density is too high, with 20 bedrooms and not enough parking,” said Chairwoman April O’Connor. “I can almost envision this as sober living homes, even though we can’t disallow that, it is a potential that I think we have to consider that this could very well turn into something way more than we’re anticipating and perhaps our code doesn’t necessarily keep up with.”
Nelson said the commission should give every permit application the same treatment, and since the project is up to code, he would vote to approve it.
Murphy said she was torn, but did agree with Nelson.
“I’m sure it can be fixed, but the way it is right now, it’s a bad project,” Murphy said.
The Commission voted four to one, with Nelson against, to table the discussion.
The next meeting will be on Monday, June 27 at 6 p.m.
