Ambrose Masto, President, Board of Directors, Capistrano Bay District
The new zoning ordinance that has been proposed has many flaws and should be opposed by the City Councilmen . The ordinance is not enforceable! Does our council really believe that this proposal which is essentially a city wide approval of hundreds of businesses on our community streets can be handled by a single code enforcer?
Let’s look realistically about this issue. STRs have been banned in numerous communities because when the rental turns bad, as it often does, the neighbor’s have no protection whatsoever. They are stuck with the situation. They have no recourse and their rights have vanished. That is the reality of the situation. The rental owner has collected their fee, the city has collected their 10 percent, and the neighbor is left with nothing but frustration and anger. This occurs repeatedly and do not be fooled, there is no realistic defense for that situation.
Several cities have banned or have a current moratorium on this issue. The Council should remember their collective promise to the citizens of DP to preserve their privacy rights and reject this extremely flawed Ordinance.
